TERMS & CONDITIONS
Following Terms & Conditions are applicable when buying from and pressing w/ Zwart Goud Distribution
OWNERSHIP:
All goods remain property of Zwart Goud until paid in full. Our products are non returnable (unless agreed differently).
MASTERS
We are not holding any ownership on label’s music masters. We however need mechanical rights clearance to press your music.
Zwart Goud is not responsible for mistakes occurred on the label delivered master files. The final masters should be delivered in 1 time to avoid mistakes on the final cut.
MECHANICAL RIGHTS
Zwart Goud is not responsible for unforeseen mechanical fee’s that occurs after a certain period of time or termination of contract between the label and Zwart Goud.
TEST PRESSING & CUT
If you are not satisfied with the cut, we need a valid reasoning to approve the 2nd cut. Re-cut of the test pressings might take up to 1 month.
SHIPPING CHARGES:
Subject to change!
Due to the extreme fluctuation in pricing, ZGD determines and charges when the final delivery is confirmed.
DELIVERY:
All defective products must be reported via e-mail to distribution@zwartgoud.org within 24 hours upon receipt.
LIABILITY:
We can never be held responsible for deadlines of releases, planned dates for release parties or any kind of agreements you make with third parties.
Start planning after the test pressing is approved. Zwart Goud is not responsible for mistakes occurred on the label delivered master files.
FEE’S:
All additional credit card, paypal, bank transfer charges will be reflected to the invoices and must be paid by the customer.
CANCELATION
There is a strict financial liability on label /artist if a label / artists assign us the distributor for a pressing project or release scheme with any sorts of confirmation (email, phone & oral) and then decides to cancel. The liability fee for this cancelation is 50% on the total sum ex VAT. Should the label / artist want to return and proceed on the previously canceled project, the cancelation fee will be used as credit against the costs of pressing or release activation. If the pressing project is confirmed and ongoing in our partnered press plant, no refund is possible on the cancellation.
DUNNING / PENALTIES
Incase of breach of payment term, and late payments, Zwart Goud is entitled to charge 2% dunning fee each week on top of the total sum.
STOCK
Before ZGD officially registers and stocks the exact quantity per release, label and ZGD need to agree on the amount of records that a record label will take to self distribute and sell i.e on label’s bandcamp, etc. Incase of a breach of contract, label termination or early stock ejection when label wants to take more record copies than intended or agreed from the ZGD stock, ZGD needs to get compensated for those extra taken records by invoicing the label with ZGD distro share per record. This is because this process cuts ZGD's potential to fully get distribution share in the long run.
